Subject: Revised Regulation 32-01-01 FOR DISTRIBUTION
System Member Policy Compliance Officers,
Revisions to System Regulation 32.01.01, Complaint and Appeal Procedures for Faculty Members <http://policies.tamus.edu/32-01-01.pdf> , were approved by the Chancellor, effective February 2, 2012. The updated version is posted on the system policy website.
A summary of the revisions follows:
This regulation was revised to clarify the default process for faculty complaints not addressed elsewhere in system policies and regulations and to provide an avenue for complaints in compliance with Texas Government Code § 617.005.
Regulation Statement: New language clarifies that this regulation applies only to faculty members of the system's academic institutions, i.e., all universities and the health science center. NOTE: Employees of system member agencies with faculty titles do not fall within the scope of this regulation and will remain subject to the complaint and appeal process for non-faculty employees established in System Regulation 32.01.02, Complaint and Appeal Process for Nonfaculty Employees.
Section 2.1: Revised language clarifies that complaint and appeal provisions are established elsewhere in other system policies and regulations for certain categories of complaints; thus, procedures established in this regulation apply only when procedures are not specified elsewhere.
Section 2.2 (previous): This section was deleted as unnecessary in light of revisions to Section 2.1.
Section 2.2: New language clarifies that this regulation applies to faculty members as defined by each system academic institution.
Section 3: New language emphasizes that retaliatory action against a complainant is strictly prohibited.
Section 3.2 (previous): This section was deleted in light of revisions to former Section 3.3, now Section 3.2.
Section 3.2: Revised language requires system members to establish procedures for handling complaints subject to this regulation.
Section 3.4 (previous): This section was deleted as unnecessary in light of revisions to former Section 3.3, now Section 3.2, which requires system members to establish procedures for handling complaints subject to this regulation.
All other revisions are to align with system style guidelines.
For your convenience, the annotated version of this regulation is attached for those who wish to review the revisions.
Feel free to distribute this regulation among your staff as you deem appropriate.
Please address any specific questions you may have regarding this regulation to the Contact Office noted. Thank you.
