We have a residency scenario we'd like some input on from others.


Student A,B and C are siblings.  Student  A attends a state university and receives in state tuition starting Fall 2014.  We realize we can student A based on what the previous institution coded them.  Student B attends our college starting in Fall 2014 and is coded out of state.  Student C applies to attend our college to start Fall 2015.  We determine students B and C should be coded out of state.  These students are basing their claim to residency on their father. The father was honorably discharged/retired from the military in December 2014 after 20 years of service and moves to Texas to be with the family.  The Leave and Earnings Statements he submitted show Texas as his state of residence (yet he has lived in Virginia for the last several years).  The father has registered his cars in Texas, has a Texas Driver's license and has been working in the state since February 2014.  And Dad hasn't met the 12 months present in the state, since he did not arrive here until December 2014.

In reviewing the College For All Texans website as well as the residency rules the only thing we can find that would apply to their situation would be the section, (http://www.collegeforalltexans.com/apps/financialaid/tofa2.cfm?ID=502) Military:  Honorably Discharged, Separated or Retired Veterans who Move to Texas.

Individuals who:
*        Are former members of the U.S. Armed Forces or former Commissioned Officers of the U.S. Public Health Service;
*        Are retired or have been honorably discharged;
*        Have enrolled in a Texas public college or university for any term or semester at a state institution of higher education that begins before the first anniversary of the member's separation; and
*        Have met the following requirements :
o   At least one year preceding the first day of the term or semester executed a document with the applicable service branch that is in effect on the first day of the term or semester that (a) indicates the member's permanent residence address is in Texas and (b) designates Texas as the member's place of legal residence for income tax purposes;
o   Registers to vote in Texas for the entire year preceding the first day of the term or semester; and
o   Satisfies at least one of the following:
?  for the entire year preceding the first day of the term or semester has owned real property in Texas and in that time has not been delinquent in the payment of any taxes on the property;
?  Has had an automobile registered in Texas for the entire year preceding the first day of the term or semester; or
?  At least one year preceding the first day of the term or semester executed a will that has not been revoked or superseded indicating that the member is a resident of this state and deposited the will with the county clerk of the county of the member's residence under Section 71, Texas Probate Code.

I'm sure I've left some information out, please ask questions.  What are we missing?  We want to code the students B and C to in state, but just can't see how it could be done based on the rules in place.
