However, I would like to focus on the TEC 54.214(k) which is the waiver related to VA funded education programs such as GI Bill and the Post 9/11 program.

Yes if the veteran is in orders; no if he just moved from one state to another.
To provide a waiver of nonresident tuition to the member, spouse and dependent children of non-Texas members of the U.S. Armed Forces and Commissioned Officers of the Public Health Service while they are stationed in Texas.
Military: Assigned to Duty in Texas
Program Purpose
To provide a waiver of nonresident tuition to the member, spouse and dependent children of non-Texas members of the U.S. Armed Forces and Commissioned Officers of the Public Health Service while they are stationed in Texas.
Eligibility Requirements
Individuals who are members of the U.S. Armed Forces or Commissioned Officers of the Public Health Service from states other than Texas, their spouses and/or children.
Although nonresidents, the member, spouse and children may pay the resident rate while stationed in Texas.
Eligible Institutions
Limited to Texas public colleges and universities.

Hello everyone,
My question is in reference to TEC 54.241(k).
Scenario:
The military vet is eligible for VA benefits as described in TEC 54.214(k) and is currently using the benefits.  The student is coded as an out-of-state student, and received the waiver of state tuition.
The spouse of the Vet listed above is coded as an out-of-state student.  She is not eligible for VA benefits.  Would you/Do you issue the Waiver of state tuition under the provisions of TEC 54.241 (k)?
