SUBJECT: CPT Extension Policy
There will be a change in the CPT extension policy effective 2/15/05. This
change will only apply to students on CPT beginning in the spring 2005
semester and thereafter.
It will NOT affect students who were authorized for CPT prior to the spring
2005 semester.
To be in compliance with more restricted SEVIS function and clearer
interpretation of the Immigration regulations, we will no longer continue
the practice of extending CPT to the following semester that students are
not actually registered for the course but are given approval for an
incomplete in the course. Students can still do CPT but only when they
actually registered for the course. Students must apply for OPT in the last
registered semester and be on OPT while working on an incomplete course.
Example: Sue is a graduate student majoring in Computer Science since Fall
03. Sue has maintained her full time enrollment and her legal F-1 status. In
the spring 2005 semester, she has registered for only 3 hours of CSCI 595
because this is her last required course left before she can complete her
degree. While registering for CSCI 595, she is offered a job in New Jersey.
She wants to take the job and has asked her professor to extend her CSCI 595
to an incomplete until the fall 05 semester. Her professor approves her
extension and grants incomplete for the course. She has an appointment with
the International Student Adviser (ISA) and brings the job offer letter, an
approval for CPT and extension from the professor, and FORM I-538 with her.
The ISA authorizes her for CPT. The ISA can only authorize her CPT until the
end of the spring 05 semester (May 14, 2005). If Sue wants to continue her
employment after May 16, she must apply for OPT during her CPT (before May 6
or sooner) so that she can be on OPT while working on her incomplete course
and can continue her job on OPT without any gap.
Reminder: A student must have completed at least 2 full semesters, fall and
spring or spring and fall, as a full time student in legal status to be
eligible for CPT.
You would not be eligible for CPT if you are a student in your first and
second semesters of your full time enrollment.
